This website is normally accessible to users at all times. However, Alex Kong may decide to interrupt access for technical maintenance purposes, in which case he will endeavour to inform users in advance of the dates and times of the intervention.

The ITAK IT website is updated regularly by Alex Kong. Likewise, this legal notice may be amended at any time; it is nevertheless binding on users, who are invited to refer to it as often as possible in order to familiarise themselves with it.

The purpose of the ITAK IT website is to provide information about all of the company’s activities.

Alex Kong endeavours to provide information on the ITAK IT website that is as accurate as possible. However, he cannot be held liable for any omissions, inaccuracies or failures to update, whether caused by him or by the third-party partners who supply him with such information.

4. Contractual limitations on technical data

Any unauthorised use of the website or of any of the elements it contains will be deemed to constitute infringement (contrefaçon) and will be prosecuted in accordance with Articles L.335-2 et seq. of the Code de la propriété intellectuelle (French Intellectual Property Code).

6. Limitation of liability

Alex Kong cannot be held liable for any direct or indirect damage caused to the user’s equipment when accessing the ITAK IT website, resulting either from the use of equipment that does not meet the specifications set out in section 4, or from the occurrence of a bug or an incompatibility.

Nor can Alex Kong be held liable for any indirect damage (such as loss of business or loss of opportunity) resulting from use of the ITAK IT website.

7. Personal data management

In France, personal data are protected in particular by Law No. 78-17 of 6 January 1978, Law No. 2004-801 of 6 August 2004, Article L. 226-13 of the Code pénal (French Criminal Code) and the European Directive of 24 October 1995.

When the ITAK IT website is used, the following may be collected: the URL of the links through which the user accessed the ITAK IT website, the user’s internet service provider and the user’s Internet Protocol (IP) address.

In any event, Alex Kong only collects personal information about the user as required for certain services offered by the ITAK IT website. The user provides this information in full knowledge of the facts, in particular when entering it themselves. Users of the ITAK IT website are then informed whether or not they are required to provide this information.

In accordance with Articles 38 et seq. of Law No. 78-17 of 6 January 1978 “relative à l’informatique, aux fichiers et aux libertés” (French Data Protection Act), every user has the right to access, rectify and object to personal data concerning them, by submitting a written and signed request, accompanied by a copy of an identity document bearing the holder’s signature, and specifying the address to which the reply should be sent.

No personal information about users of the ITAK IT website is published without the user’s knowledge, or exchanged, transferred, assigned or sold on any medium whatsoever to third parties. Only in the event of the acquisition of Alex Kong and his rights could such information be passed on to the potential acquirer, who would in turn be bound by the same obligation to store and modify the data with respect to users of the ITAK IT website.

The website has not been declared to the CNIL (Commission nationale de l’informatique et des libertés, the French data protection authority) as it does not process personal data, as indicated on this page.

Databases are protected by the provisions of the Law of 1 July 1998 transposing Directive 96/9 of 11 March 1996 on the legal protection of databases.

The ITAK IT website contains a number of hyperlinks to other websites, set up with the authorisation of Alex Kong. However, Alex Kong is unable to verify the content of the websites visited in this way and therefore accepts no liability in this respect.

9. Governing law and jurisdiction

Any dispute relating to the use of the ITAK IT website is subject to French law. Exclusive jurisdiction is granted to the competent courts of Paris.
